Statutory Broker (No
Agency Contract with Buyer or Seller)
Whether
or not you choose to sign an agency contract with me, I am obligated to provide
these services to everyone

Disclosure of any
adverse material fact* concerning the property that is known to the salesperson
and not known to the buyer.

Disclosure of any adverse
material fact*, known to the salesperson, and not to the seller, concerning the
buyers intent or ability to perform on the purchase offer.
·
To exercise reasonable
skill and care and diligence in the performance of my duties.
·
To follow federal and
state laws, rules and regulations and promote equal access for everyone to
housing.
Adverse Material Fact means a fact that should be recognized by an Agent
as being of enough significance as to affect a person’s decision to enter into a
contract to buy or sell real property. It may be a fact that materially affects
the value or structural integrity or presents a documented health risk to
occupants of the property, but may not include the fact that an occupant of the
property has or has had a communicable disease or that the property was the
site of a suicide, or felony, or it may be a fact that materially affects the
buyer's ability or intent to perform the buyer's obligations under a proposed
or existing contract.
I will
perform as a Statutory Broker for you unless or until you or the other party to
a purchase agreement have chosen to sign a separate contract(s) with me.
Designated Seller Agent

Upon signing a
listing contract with me, I act
solely on behalf of the seller in working with buyers not under Buyer Agency
contract with me.
·
I owe the seller
reasonable care, undivided loyalty, confidentiality, full disclosure,
accounting, and obedience.
·
I work with but don’t
represent buyers in the purchase of my listing unless or until a buyer signs a
Buyer Agency Contract with me; then I follow the Dual Agency policy.
·
I act as Statutory
Broker or Buyer's Agent for property not listed with me.
·
I treat all buyers
honestly and pledge myself to the same obligations listed above under Statutory
Broker.
Designated Buyer
Agent
·
Upon signing a
Buyer’s Agency contract with me, I
act solely on behalf of the buyer for property not listed
with me.
·
I owe the buyer
reasonable care, undivided loyalty, confidentiality, full disclosure,
accounting, and obedience.
·
I can work with but not represent a seller in purchases by our buyer
client unless or until the buyer selects a property listed with me; then I
follow the Dual Agency Policy.
·
I treat all sellers
honestly and pledge myself to the same obligations listed above under Statutory
Broker.
Dual Agent
·
I represent the buyer by
contract AND I represent the seller by contract.
·
The Buyer becomes
interested in one of my listings.
·
I will represent both
parties in a limited capacity in that I will not share personal information
about the parties and their motivations to each other, but pledge myself to the
same obligations listed above under Statutory Broker.
Each party will receive and acknowledge a Dual Agency Addendum to their Listing Contract or Buyer Agency contract.
